The City Planning Commission was created by the City Council. Its powers and duties include: to develop and maintain the General Plan; to make recommendations to the City Council on amendments to the General Plan and the City’s zoning code and on zoning changes; to act upon applications for tentative subdivision maps, special permits and variances; and to make environmental determinations associated with these actions.
Notice to the Public
You are welcomed and encouraged to participate in this meeting. Public comment is taken (3 minutes maximum) on items listed on the agenda when they are called. Public Comment on items not listed on the agenda will be heard at the end of the meeting as noted on the agenda. Comments on controversial items may be limited and large groups are encouraged to select 3-5 speakers to represent the opinion of the group.
Notice to Lobbyists: When addressing the Commission you must identify yourself as a lobbyist and announce the client/business/organization you are representing (City Code 2.15.160).
Speaker slips are located in the lobby of the hearing room and should be completed and submitted to the Commission Secretary.
Government Code 54950 (The Brown Act) requires that a brief description of each item to be transacted or discussed be posted at least 72 hours prior to a regular meeting. The City posts Agendas at City Hall as well as offsite meeting locations.
The order of agenda items is for reference; agenda items may be taken in any order deemed appropriate by the Commission. The agenda provides a general description and staff recommendations; however, the Commission may take action other than what is recommended. The agenda is available for public review on the Friday prior to the meeting. Hard copies of the agenda, synopsis, and staff reports are available from the Planning Department at 915 I Street, New City Hall, 3rd Floor (25 cents per page), during regular business hours or can be downloaded at www.cityofsacramento.org/dsd.

- M08-040 Shovel-Ready Sites Program (Noticed on 12/8/08)

Recommendation: Forward to City Council with the Recommendation to Approve an ordinance amending Sections 17.191.050 and 17.195.060 of Title 17 of the Sacramento City Code (the Zoning Code) to allow for the transfer of funding froInfill Fee Reduction Program (I06000300) and Low Income Fee Waiver/Deferral Program (I06000400) to fund the Shovel-Ready Sites Program (D21001300).

- 2030 General Plan Implementation: Rezones and Zoning Code Update

Action: No public comment. Commission reviewed and commented.
- Del Paso Heights Redevelopment Plan Amendment
Location: Del Paso Heights Redevelopment Project Area – Council District 2
Recommendation: Staff recommends the Commission approve the Record of Decision (Attachment 1) making a report and recommendation from the Planning Commission on its findings to the City Council and the Redevelopment Agency. There are no outstanding issues or opposition to the project at the time this staff report was written.

Questions, Ideas and Announcements of Commission Members
- Commissioner Samuels wanted to discuss what occurred during the Delta Shores public hearing item at the December 11, 2008 Planning Commission meeting. Her first item of concern was that the applicants role in the process, stating that the commission knows that often times the applicant has timelines, but they should follow those timelines instead of putting the burden and the “rush to judgment” on the commission members. Stating that the applicant needs to allow for mitigating circumstances that could affect the projects timeline. Second issue is as it relates to the roles and duties of the Planning Commission, thoughtful consideration and discussion is a responsibility of the commission and the items/agenda should allow plenty of time particularly for large projects. The problem with the hearing on Delta Shores was that many concerns were left unexpressed because there was a lack of time during the meeting, because of the length of the meeting, in which to hear them all. A third concern was the motion that was finally acted upon was a motion to substitute, but by policies and procedures the substitute motion needs to be compatible with the original motion and was the substitute motion really compatible with staff recommendation. The nature of the motion was an action to take no action. Commissioners Samuels fourth comment/concern was to suggest that an amendment to the policies and procedures be made that the commission can not make a motion and take action on a motion that is to take no action.
- Commissioner Wasserman requested that the City Manager be invited to have a dialogue with the Commission regarding what the expectations are from the City Managers Office of the Planning Commission.
- Commissioner Contreraz asked what the status was on the Crystal Creamery demolition clean up was. He stated that when the applicant proposed the demolition that he was specifically asked when the clean-up of the site would take place. The commission had been assured that it would happen immediately and it has been sometime since the demolition occurred but no clean-up has happened.
- Commissioner Bartholomy reminded the commission about the Level of Service workshop that would be taking place on December 19, 2008 from 9:00-12:00 p.m. He let the commission know that he would send them the information if they were interested and that the City’s very own Sparky Harris was to be one of the keynote speakers.
