MISSION STATEMENT

The Procurement Services Division's Contract Services Unit provides customer service in contract administration through education, training, and compliance enforcement.  Our services are provided in a timely manner consistent with legal, ethical and equitable code and policy applications.  We maximize efficiencies and cost effectiveness in all aspects of procurement and contracting.

Regulations

The City of Sacramento administers competitively bid contracts in accordance with various Federal, State of California and City of Sacramento codes. It is the intent of these codes to achieve the following objectives: (a) To clarify the law with respect to competitive bidding requirements; (b) To ensure full compliance with competitive bidding statutes as a means of protecting the public from misuse of public funds; (c) To provide all qualified bidders with a fair opportunity to enter the bidding process, thereby stimulating competition in a manner conducive to sound fiscal practices and (d), to eliminate favoritism, fraud, and corruption in the awarding of public contracts. The Sacramento City Code authorizes alternative and noncompetitive contract procedures, including Request for Proposal and Request for Qualifications.

City of Sacramento Standard Specifications for Public Projects

The City of Sacramento has adopted Standard Specifications (DOC) for its "Public Projects" as defined in the Sacramento City Code.  These standards, plans, and details are incorporated by reference in the project's special provisions or technical specifications.  Contractors are encouraged to review these specifications prior to bidding.  (To see updates and amendments to the Standard Specifications, click here.)

Equal Benefits Ordinance

On November 4, 2004, the Sacramento City Council enacted the Non-Discrimination In Employee Benefits By City Contractors Ordinance, otherwise known as the Equal Benefits Ordinance (EBO); enacted as City Code Chapter 3.54 with an effective date of April 1, 2005.

Accordingly, all applicable City contracts and agreements with a submission or renewal date on or after April 1, 2005, need to comply with the requirements of the Ordinance.

Forms related to the Equal Benefits Ordinance:

Contract Language - The Non-Discrimination In Employee Benefits By City Contractors language must be included in any bid specifications, application materials, notices inviting bids, or any other solicitations.

Declaration of Compliance - All contractors entering into contract or agreement with the City of Sacramento, which face value equals or exceeds $25,000.00, must submit a completed "Declaration of Compliance" form, signed by an authorized reprsentative, with each proposal, bid, or application, prior to the City's execution of the contract or agreement. The "Declaration of Compliance" form will be made a part of the executed contract or agreement and will be made available for public inspeciton and copying during regular business hours.

Notice to Employees - An employer covered by the EBO is required to provide written notification to each new and existing employee working directly on a City contract. An informational poster to this effect also needs to be displayed in an area visible to employees.

Living Wage Ordinance

On December 9, 2003, the Sacramento City Council enacted a Living Wage Ordinance (the “LWO”) in accordance with Sacramento City Code Chapter 3.58. The LWO requires certain firms that enter into contracts to provide certain services to or for the City, to pay a specified minimum level of compensation to their employees for time spent performing any work on the City contract. The LWO also applies to certain subcontractors. The LWO applies to contracts entered into, amended, or renewed or extended at the City’s discretion, on or after March 1, 2004 (the “LWO Effective Date”).

Current 2006 living wage rates are:

     - $9.67 per hour if employer's contribution for health benefits is at least $1.50 for each hour of work.

     - $11.17 per hour if employer's contribution for health benefits is not at least $1.50 for each hour of work.    

New Living Wage rates effective APRIL 21, 2008

  - $10.33 per hour if employer's contribution for health benefits is at least $1.50 for each hour of work.

 - $11.88 per hour if employer's contribution for health benefits is not at least $1.50 for each hour of work.

Living Wage Requirements (PDF) - The "Living Wage Requirements" must be included in any bid specifications, application materials, notices inviting bids, or any other solicitations for non-professional services covered or potentially covered by the LWO. These "Living Wage Requirements" also include the "Declaration of Compliance."

Declaration of Compliance (PDF) - All contractors seeking a City Contract for non-professional services are required to submit a completed "Declaration of Compliance" form, signed by an authorized representative, with each proposal, bid or application, prior to the City's execution of the contract. The "Declaration of Compliance" form will be made a part of the executed contract and will be made available for public inspection and copying during regular business hours.

Direct Connect - The Direct Connect program is designed to enhance the economic status of low-income wage earners by connecting them with access to programs and services that enhance their economic status. Direct Connect is a companion program to the City’s Living Wage Ordinance. The program is a collaborative effort of the City of Sacramento, Sacramento Metropolitan Chamber of Commerce, County of Sacramento, Community Services Planning Council and the Sacramento Employment and Training Agency.

Notice To Employees - An employer covered by the LWO is required to provide written notification to each covered employee of the minimum wage amounts required by the LWO. The notification is to be provided in each language spoken by 10% or more of the Covered Employer's workforce. Here are the notifications in a selection of languages:

Prevailing Wage

In accordance with Sacramento City Code Section 3.60.180, Contractors and Subcontractors shall comply with the rates of wages currently established by the Director of Industrial Relations under provisions of Sections 1773 of the Labor Code of the State of California (Journeyman wages; apprentice wages). However, the payment of the general prevailing rate of per diem wages or the general prevailing rate of per diem wages for holiday and overtime is not required for any Public Construction project of $25,000 or less, or for any Public Maintenance project of $15,000 or less (Section 1771.5 of the California Labor Code).

The City of Sacramento has an approved Labor Compliance Program.

In addition, Sacramento City Code Section 3.56.070 (Prevailing wages for certain services), requires payment of a prevailing wage, determined from time-to-time by the City Manager, in every contract for laundry, janitorial, or window washing services.
