Community Benefits Ordinance

On May 12, 2021, the City of Sacramento, the Regents of the University of California, and Sacramento Investment Without Displacement (SacWID) entered into a settlement agreement regarding the Aggie Square Project (Settlement Agreement). The Settlement Agreement included a provision requiring the City to endeavor to bring forward a Community Benefits Ordinance (CBO) for City Council consideration.

Utilizing the provisions listed in the Aggie Square Settlement Agreement, a framework to facilitate the drafting of the Community Benefits Ordinance was presented to the Law and Legislation Committee on March 29, 2022.

Throughout 2022, City staff met with SIWD to further the framework and ordinance. On August 15, 2002 a Developer and Business Community Meeting 8/15/22 was held to solicit additional input.

In late September 2022, the City crafted a more detailed Community Benefits Ordinance framework. Based on the feedback received, the Draft Community Benefits Agreement Ordinance was drafted.

The draft Community Benefits Ordinance is designed to apply to large public-private projects receiving economic subsidies in the amount of $10 million dollars or more from the City of Sacramento. Developers of the applicable projects would be required to negotiate and enter into a Community Benefits Agreement (CBA) with the City. The CBA would include language about small/ local business protection/support, anti-displacement strategies and local hiring. The negotiated CBA would be approved in conjunction with the Council action on the provision of the City assistance for the project. Certain projects, including City infrastructure or public improvement projects, projects with non-profit partners or beneficiaries, and affordable housing projects, would not be subject to this ordinance.
